Please read these Terms of Service carefully before purchasing from or using MotoFloat ("we," "us," or "our"), operated at motofloat.shop. By accessing or placing an order through this website, you agree to be bound by these terms.

1. Third-Party Supplier & Manufacturing

MotoFloat is a retail brand and sales platform only. All products sold through MotoFloat are designed, manufactured, assembled, tested, and shipped by independent third-party suppliers and manufacturers ("Suppliers"). MotoFloat does not manufacture, assemble, inspect, or physically handle any product prior to fulfillment. We act solely as a retail intermediary between you and the Supplier.

By completing a purchase, you acknowledge that (a) MotoFloat has no control over the manufacturing process, materials used, quality assurance procedures, or physical condition of any product; and (b) all product-related claims, defects, or safety concerns are the responsibility of the Supplier.

2. Assumption of Risk

You expressly acknowledge and agree that the use of motorized inflatable watercraft and related water-recreation products carries inherent risks, including but not limited to drowning, bodily injury, property damage, and death. By purchasing and using any product sold through MotoFloat, you voluntarily assume all such risks.

You agree to: (a) read and follow all manufacturer instructions and safety guidelines before use; (b) ensure all users are capable swimmers or wear appropriate personal flotation devices; (c) comply with all applicable local, state, and federal laws governing watercraft operation; and (d) never use the product in conditions beyond its rated specifications.

3. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ALL PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. MOTOFLOAT EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, SAFETY, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

MOTOFLOAT MAKES NO REPRESENTATION OR WARRANTY THAT ANY PRODUCT IS FREE FROM DEFECTS, WILL OPERATE WITHOUT INTERRUPTION OR ERROR, OR IS SUITABLE FOR ANY PARTICULAR USE. ALL PRODUCT WARRANTIES, IF ANY, ARE PROVIDED SOLELY BY THE SUPPLIER AND SUBJECT TO THE SUPPLIER'S OWN TERMS.

4. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MOTOFLOAT, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR:

  • ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR PURCHASE OR USE OF ANY PRODUCT;
  • ANY PERSONAL INJURY, BODILY HARM, DEATH, OR PROPERTY DAMAGE CAUSED BY OR RELATED TO ANY PRODUCT;
  • ANY PRODUCT DEFECT, MALFUNCTION, FAILURE, OR NON-CONFORMANCE;
  • ANY ACTS OR OMISSIONS OF THIRD-PARTY SUPPLIERS, MANUFACTURERS, OR CARRIERS.

IN ALL CASES, MOTOFLOAT'S TOTAL CUMULATIVE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.

5. Product Liability Disclaimer

MotoFloat expressly disclaims all product liability. All products are manufactured, assembled, and shipped by independent third-party Suppliers over whom MotoFloat exercises no control. MotoFloat shall not be liable for any product liability claims, personal injury claims, property damage claims, or any other claims arising from the design, manufacture, materials, labeling, warnings, instructions, or condition of any product. All such claims must be directed solely to the Supplier or manufacturer.

6. Indemnification

You agree to defend, indemnify, and hold harmless MotoFloat and its owners, officers, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including attorneys fees) arising from: (a) your use or misuse of any product; (b) your violation of these Terms; (c) your violation of any applicable law; or (d) any third-party claim arising from your use of a product.

7. Governing Law & Dispute Resolution

These Terms are governed by the laws of the United States. Any dispute shall first be subject to good-faith negotiation. If unresolved, disputes shall be resolved through binding individual arbitration. You waive any right to participate in a class action lawsuit or class-wide arbitration.

8. Changes to These Terms

We reserve the right to update these Terms at any time. Changes are effective immediately upon posting. Continued use of this website after changes constitutes acceptance of the revised Terms.
